Engagement Session Giveaway - Terms & Conditions
1. General
1.1 The promoter is Timeless by Nate (ABN: 518 479 560), located in the Hunter Valley, NSW.
1.2 The competition is administered via the Focal Ignite program and Focal Studio Management Team, a software platform provided by BookFocal, located in Canada (the Administrator).
1.3 By entering this competition, the entrant agrees to be bound by these Terms and Conditions.
2. Eligibility
2.1 Entry is open to residents of Australia who are over the age of 18.
2.2 Entrants must be engaged to be married, with a wedding date set between 1/11/2025 and 30/12/2027.
2.3 Engagement session must take place within 50kmkm of the Hunter Region, NSW.
2.4 Employees and immediate families of the Promoter are ineligible to enter.
2.5 No Existing Bookings - Entry is strictly limited to couples who have not yet booked or signed a contract with a professional wedding photographer for their wedding date.
2.6 Existing Clients - Couples who currently have a booking with Timeless by Nate are not eligible to enter. This competition is for new bookings only.
2.7 Professional Courtesy The Promoter respects the contracts of other service providers. Entrants who have an existing contract with another photographer are ineligible. The Promoter reserves the right to request proof that no prior booking existed if a dispute arises.
3. Competition Period
3.1 Entries open on 1/11/2025 and close on 30/12/2027.
3.2 Rolling Selection: - This is an ongoing campaign. Winners will be selected by the judges on a continuous, rolling basis throughout the Competition Period. The Promoter reserves the right to select multiple winners per month.
3.3 Winners will be contacted directly via email or Instagram DM to arrange their prize redemption.
4. How to Enter (Game of Skill)
4.1 This is a game of skill. Chance plays no part in determining the winner.
4.2 To enter, participants must:
Submit a written response (max 500 words) to the question: "Share your love story and suggest a location for your engagement photos!"
4.3 Each entry will be judged individually on its merit.
4.4 Entry Warranty - By submitting an entry, the entrant warrants and represents that they are free to enter into a contract with Timeless by Nate for the wedding date specified and are not bound by any exclusive agreement with another photography provider.
5. Judging Criteria
5.1 All entries will be judged by a panel appointed by the Promoter.
5.2 The winner will be chosen based on the following criteria:
- Emotional resonance and sincerity.
- Suitability for the Timeless by Nate photography style.
5.3 The judges’ decision is final and no correspondence will be entered into.
5.4 The Promoter reserves the right to select multiple winners throughout the period based on these criteria.
6. The Prize
6.1 The prize consists of:
- 1 X pre-session consultation with free wedding advice
- 1 X engagement OR portrait OR event OR surprise proposal session with up to 60 minutes photography coverage
- 10 X digital images
- A travel fee of up to $110 AUD is payable by the winner for sessions conducted within 80km of Pokolbin, NSW (2320).
- Locations outside this radius will incur higher travel fees to be quoted by the Promoter prior to the session.
6.2 Total Prize Value - $490 AUD.
6.3 The prize is not transferable or exchangeable and cannot be taken as cash.
6.4 Availability - If the winner's wedding date is already booked by the Promoter, the prize cannot be redeemed (unless at the discretion of the promoter), and a runner-up may be selected.
6.5 Redeeming the prize does not obligate the entrant to book the Promoter for their wedding, nor does it guarantee the Promoter’s availability for the wedding date until a separate booking contract is signed.
7. Privacy & Data
7.1 The Promoter collects personal information ("PI") to conduct the promotion and may disclose such PI to the Administrator (BookFocal) for processing.
7.2 By entering, the entrant acknowledges that their data may be stored on servers located outside of Australia (specifically North America).
7.3 Entrants consent to the Promoter using their PI to contact them regarding wedding photography services.
8. Intellectual Property
8.1 By entering, you grant the Promoter permission to use your submitted love story, photos and name for promotional purposes on social media and the website without further compensation .
9. Liability
9.1 The Promoter is not liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) in connection with this competition or accepting the prize.
10. Instagram/Facebook
10.1 This promotion is in no way sponsored, endorsed, administered by, or associated with, Instagram or Facebook.
